Terms of Booking, Cancellation, and Privacy Policy

Welcome to E&D Vietnam Adventures LLC ("Company," "we," "us," or "our"). By requesting a quote, making a deposit, or booking a tour or service with us, you ("Client," "Guest," or "you") agree to the terms, conditions, and privacy practices outlined below.

SECTION 1: PRICING, QUOTES, & BOOKING TERMS

1.1 Quote Validity

  • Quotes Without Down Payment: Any quote provided without a secured down payment is valid only through the last calendar day of the month in which it was issued. Rates are subject to change on the first day of the following month if a down payment has not been received.

  • Secured Bookings: Once a down payment is received, booking prices are guaranteed for a period of three (6) months from the date of the payment, provided all remaining installments/balances are paid according to the agreed schedule within that 3-month window.

1.2 Booking Window

All bookings are scheduled within a three (3) month operational window from the date of confirmation, unless an alternative timeline is explicitly agreed upon in writing by E&D Vietnam Adventures LLC.

SECTION 2: CANCELLATION & REFUND POLICY

We understand that travel plans can change. However, due to advance financial commitments made with our third-party suppliers, the following tiered refund terms apply strictly to all cancellations:

2.1 Prorated Refunds (30 to 89 Days)

Cancellations made between 30 and 89 days prior to the departure date will be evaluated for a prorated refund. Refunds in this window are calculated by deducting any non-recoverable expenses already incurred on your behalf—including, but not limited to:

  • Non-refundable hotel deposits or guaranteed room bookings

  • Domestic/international airfare, train, or cruise tickets

  • Local transportation, activity fees, and permit fees

  • Non-refundable administrative and merchant processing fees

2.2 Short-Notice Cancellations & Special Circumstances (<30 Days)

Cancellations made within 30 days of the departure date are generally non-refundable.

  • Special Circumstances: In extraordinary cases (e.g., severe medical emergencies, sudden family bereavement, or major force majeure events), prorated refunds or trip credits may be evaluated at our sole discretion.

  • Action Required: Please contact us immediately if you face an emergency situation so we can attempt to negotiate with suppliers and minimize cancellation penalties on your behalf.

Travel Insurance Disclosure: E&D Vietnam Adventures LLC strongly recommends that all clients purchase comprehensive travel, medical, and trip-cancellation insurance to cover unforeseen personal emergencies, delays, or medical evacuations.

SECTION 3: MEDIA & PHOTOGRAPHY RELEASE

By participating in a tour or activity operated or arranged by E&D Vietnam Adventures LLC, you grant us a perpetual, worldwide, royalty-free, non-exclusive license to take, use, reproduce, and publish promotional photos, videos, or digital media captured during your trip across our website, social media channels, and marketing materials.

  • Opt-Out Rights: If you do not wish to be photographed or filmed, or if you prefer that images of you or your party are not used for marketing purposes, you must notify us in writing prior to the start of your tour at [Info@edvietnamadventures.com].

  • Upon written request, we will make every reasonable effort to ensure you are excluded from media captures or remove published digital media where feasible.

SECTION 4: PRIVACY POLICY & DATA SHARING

Your privacy is important to us. This section details how we collect, use, and share your personal information.

4.1 Information We Collect

To arrange your travel itineraries, we collect personal information including, but not limited to: full names, passport details, dates of birth, dietary requirements, relevant medical/accessibility information, contact details, and payment information.

4.2 Sharing with In-Country Operational Partners

By booking with us, you explicitly grant E&D Vietnam Adventures LLC permission to share your necessary personal information with our third-party and in-country partners in Vietnam (e.g., local tour guides, drivers, hotels, cruise operators, domestic airlines, and activity vendors) strictly to the extent required to execute your travel services safely and effectively.

4.3 Mandatory Legal Disclosures

We reserve the right to disclose your personal information without prior notice if required to do so by law, court order, search warrant, or governmental regulation, or if we believe in good faith that such disclosure is necessary to:

  • Comply with legal processes or law enforcement requests (both in the United States and Vietnam).

  • Protect the rights, safety, or property of E&D Vietnam Adventures LLC, our clients, staff, or the general public.

4.4 Data Security

We implement reasonable physical, technical, and administrative safeguards to protect your personal information from unauthorized access, loss, or disclosure. We do not sell, rent, or trade your personal information to third parties for independent marketing purposes.

SECTION 5: LIMITATION OF LIABILITY & DISCLAIMER

5.1 Independent Suppliers

E&D Vietnam Adventures LLC acts strictly as an intermediary and independent booking agent arranging services provided by independent third-party suppliers (e.g., local guides, hotel properties, airlines, ground transport companies). We do not own, operate, or control these independent vendors. E&D Vietnam Adventures LLC shall not be held liable for any injury, loss, delay, death, or property damage caused by the negligence, defaults, or omissions of these third-party suppliers.

5.2 Force Majeure

E&D Vietnam Adventures LLC assumes no liability for disruptions, cancellations, expenses, or losses resulting from events beyond our reasonable control (Force Majeure), including but not limited to: severe weather, natural disasters, acts of government, strikes, civil unrest, quarantine, or epidemics.

SECTION 6: GOVERNING LAW & DISPUTE RESOLUTION

6.1 Governing Law

This Agreement, and all claims, disputes, or liabilities arising out of or relating to your booking or these terms, shall be governed by, construed, and enforced strictly in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law principles.

6.2 Exclusive Jurisdiction and Venue

You agree that any legal suit, action, or judicial proceeding arising out of or related to your booking with E&D Vietnam Adventures LLC shall be instituted exclusively in the state or federal courts located in North Carolina. You hereby irrevocably submit to the personal jurisdiction of such courts and waive any objection to forum non conveniens.

6.3 Acknowledgment of Terms

By submitting a down payment or securing a booking, Client acknowledges that all pricing policies, quote timelines, cancellation fees, and non-refundable deposit terms were clearly disclosed prior to payment in full compliance with North Carolina consumer protection laws (N.C.G.S. § 75-1.1).
